Terms and Conditions

Your contract with Chilepros Travel Corp. (“Chilepros Travel”) is subject to the terms and conditions listed below:

1. Purchase of Travel Services
Upon purchase of Travel Services (“Travel Services”) from Chilepros Travel, you will receive an itinerary with specific details about what is included in your package (such as airfare, meals, transfers, accommodations and entrance fees). All Travel Services offer professional guides and/or shared services (inter-city scheduled buses) without a guide. Shared services require a minimum number of participants.

2. Exclusions from the Quoted Prices
The following items are excluded: costs of obtaining passport (if required); excess baggage charges; travel insurance; airfares and airport departure and arrival taxes; any item or service not specifically listed in the itinerary as included and any expenses of a personal nature. Please note that Chilean hotel rates do not include Value Added Tax (I.V.A.). Non-resident foreigners are exempt of I.V.A. on their Chilean hotel accommodation by presenting a valid passport and tourist card at check-in. The I.V.A. exemption applies during your stay and also applies to your consumption in the hotel. Should you fail to honour your hotel booking in Chile, you must pay the I.V.A. as the hotel booking is 100% non-refundable.

3. Baggage
Baggage handling is only included in the Travel Services if indicated in the itinerary. Unless insured, ALL Baggage and personal effects remain at the owner's risk. Check with your airline for baggage restrictions applicable to flights. Travel insurance which provides protection against lost and damaged luggage, is strongly recommended.

4. Travel Insurance
You are wholly responsible for arranging your own travel insurance. Chilepros Travel is not liable for any Client who has failed to purchase adequate travel insurance.

5. Documentation
It is the Client's responsibility and cost to obtain all necessary documentation required by any country which you will be visiting. You should also be aware of and comply with all vaccinations and/or any additional conditions necessary to enter the countries visited. In case of non-compliance or misinformation, you are liable for any costs incurred.

6. Client Information
It is the responsibility of the Client to provide Chilepros Travel with your information, at least one week prior to your departure. This applies to Clients that will travel in crafts such as Australis Cruises, Skorpios, Lake Crossing and others, or with local airlines. The minimum Client information required is: full name, date of birth, citizenship and passport number.

7. Payment Schedule
A deposit of thirty percent (30%) of the Price (“Price”) is required at the time you confirm the Reservation (“Reservation”), at which time you will receive your invoice. The remainder of the price must be paid ninety (90) days before the delivery of the Travel Services. Should you reserve less than ninety (90) days before the delivery of the Travel Services, the entire Price of Travel Services must be paid at the time of confirmation.

8. Change Fees
Any changes to the original Reservation must be made in writing by the person who made the original Reservation and must be accompanied by an administration charge of twenty-five dollars ($25) per Reservation, per person in addition to the cost of any other Services required. We will do our best to accommodate additional requests - however, such availability cannot be guaranteed.

9. Cancellation Requests
All cancellation requests must be made in writing. A full refund less cancellation fee of $200/person in addition to the cost of any other Services required will be issued for any cancellation at least 61 days prior to departure. Penalty for cancellations within 60 days of departure will be assessed as follows: 60-31 days equal to 20% of Price in addition to the cost of any other Services required, and 30 days or less equal to 100% of Price. Cancellation charges will be calculated based on the date Chilepros Travel receives notice of cancellation. In addition to the above, airfare cancellations are subject to $25 per person per airfare in addition to any penalties imposed by the airline company.

There will be no refunds for missed Travel Services. In the event that certain Travel Services are cancelled, Chilepros Travel will have no responsibility beyond the refund of all monies received by Chilepros Travel, which will be deemed to constitute full settlement.

10. Claims and Refunds
Except for verifiable extenuating circumstances, refunds will not be made for any missed Travel Services. Please see our Limit of Responsibility below. For verifiable claims to be considered, they must be received in writing within thirty (30) days after termination of the Travel Services and be accompanied by supporting documentation and/or a statement from the service provider verifying the claim. Adjustments will not be made for unused Travel Services. Claims or demands made after thirty (30) days will not be responded to. Claims must be in writing and sent by mail to the address of Chilepros Travel below prior to the commencement of any legal proceedings and under no circumstances may the amount of the claim exceed the Price of the Travel Services purchased by the Client.

11. Limit of Responsibility
Your booking for any Travel Services involves an agreement between you and the Chilepros Travel contractors and suppliers (“Service Providers”) who provide transportation, accommodation and other related services. Chilepros Travel acts only as agent for these Service Providers and is not responsible for any of their acts and/or omissions. All Travel Services provided are subject to the Travel Agents Act in BC and its regulations. The Travel Services are also subject to conditions imposed by Service Providers - their liability is limited by their own rates, terms and conditions, tickets, vouchers and international conventions and agreements.

Certain Travel Services include outdoor physical activity and contact with nature, involving some level of risk, depending on several events and circumstances over which Chilepros Travel has no control. Chilepros Travel cannot therefore, be liable for death, personal injury or any other loss that may occur (a) due to any act or omission of any such Service Provider, or (b) by reason of any other event over which it has no control. Confirmation or payment of the Travel Services constitutes your acceptance of the above exclusion of liability provision.

12. Complaints
If a Client has a complaint against Chilepros Travel while traveling, the Client must first inform the Service Provider so that he/she can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaints must be put in writing to Chilepros Travel within thirty (30) days of the days after termination of the Travel Services as explained above.

13. Acts of God and Weather Conditions
All Travel Services are subject to change without notice, depending on acts of God and weather conditions. Chilepros Travel and/or the Service Providers reserve the right to provide Clients with an alternative service if conditions are not appropriate and/or unsafe.

14. Changes to Travel Services
Chilepros Travel and/or the Service Providers also reserve the right to withdraw a Travel Service or any part of it; to make such alterations in the itinerary as seem necessary or desirable; to refuse, to accept or retain as a member of the tour, any person, at any time; and to pass on to tour members, any expenditures or losses caused by unforeseeable delays or events.

15. Photography on the Tour
Chilepros Travel and/or the Service Providers reserve the right to take photographs, films or videotapes during the use of any Travel Services, and to use the resulting photographs, film or videotape for promotional purposes. By booking with Chilepros Travel, Clients agree to allow their image to appear in such media. If you would prefer that your image and/or voice are not used for such purposes, you are asked to notify Chilepros Travel of this preference in writing at the beginning of your Travel Services.

16. Prices
All Prices quoted in the website and/or catalogue are expressed in US and/or Canadian dollars and/or Chilean pesos. All Prices are subject to change without notice, due to unexpected circumstances or weather conditions.

17. Increase in Costs
The Prices advertised are based on fixed costs. Such costs are dependent on fuel costs, rates of exchange and other factors. Should these costs increase, Chilepros Travel reserves the right to increase the Price of your Travel Services accordingly. Every effort will be made to advise the Client or the Client’s Travel Agent of any price increase at least fifteen (15) days prior to your departure date.

18. Air Transportation
Chilepros Travel will arrange the most economical airfare available in the class category requested at the time of booking. Should you cancel or change the air reservation before or after departure, the airline may impose penalties. The passenger contract issued together with the air ticket by the air carrier will constitute the sole contract between the airline and the passenger; Chilepros Travel will not be responsible for any delays, substitutions of equipment or any act of omission whatsoever by the carrier, its agent, servants and employees.

19. Flight Confirmations
Confirmation of flights is your responsibility. You may request assistance from Chilepros Travel staff; however according to Chilean airline practice, you must make all changes personally.

20. Customs and Immigration
Customs and Immigration officials can, at their own discretion, deny the clients entry into any country. A previous criminal record may be an obstacle in international travel which leads to denied entry. Chilepros Travel cannot be held responsible for denied entry under any circumstances.

21. Flights and Carriers
All flight times are subject to change with or without prior notice. Chilepros Travel recommends that each Client contact the airline within 24 hours of departure to confirm departure time and check in the flight two to three (2-3) hours prior to departure. Chilepros Travel cannot be held responsible if you miss your flight or are denied boarding. Cut-off times may vary between thirty to sixty (30-60) minutes. Chilepros Travel makes arrangements with various air services including LAN Airlines. Clients with connecting fights are advised to allow ample time (a minimum of three (3) hours) between flights. Chilepros Travel cannot accept any responsibility for additional charges incurred for airfares or other expenses as a result of irregular airline operations that result in changes to flight times and subsequent misconnections.

22. Special Needs and Special Requests
Chilepros Travel can arrange wheelchair-accessible services; however, such accessibility cannot be guaranteed under all circumstances. Special requests such as adjoining rooms, room locations, or bed preferences can be made; however, these preferences cannot be guaranteed by Chilepros Travel.

23. Credit Card
When using a credit card to confirm a payment or Reservation, the Client and/or cardholder gives consent to Chilepros Travel for use of the credit card. Chilepros Travel reserves the right to cancel a Reservation where any payment is not received within five (5) days of its due date.  (For All credit card payments we require the credit card holder to fill out and sign our Credit Card Authorization Form.)

24. Local Laws
You are expected to obey the laws and regulations of the country you visit. Any failure to do so will relieve Chilepros Travel of all obligations that it may otherwise have under these booking conditions.

25. Privacy
Chilepros Travel is committed to protecting the privacy of client personal information, including financial information. Chilepros Travel's Privacy Policy may be reviewed on the website www.chilepros.com/privacy. By purchasing Travel Services, the Client agrees that Chilepros Travel may contact him/her in connection with purchase of those Travel Services.

26. Errors, Omissions and Acceptance of Terms and Conditions
Although Chilepros Travel has made a concerted attempt to verify the accuracy of statements made herein, it cannot be held responsible for any error, omission or unintentional misrepresentations that may appear. Confirmation or payment of the Price constitutes your acceptance of the Terms and Conditions set out herein and in more specific pre-tour Client documentation, including the Booking Confirmation Form.
